1. Acceptance of Terms

Welcome to Effct. By accessing or using our service, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service.

2. Description of Service

Effct provides AI-powered sound design and audio enhancement services for video content. Our service analyzes your video content and generates synchronized sound effects, ambient sounds, and audio design elements.

3. Your Content and Privacy

3.1 Ownership

You retain all ownership rights to the videos and content you upload to Effct. We do not claim any ownership over your original content.

3.2 No AI Training

We will never use your uploaded videos, content, or generated audio for training our AI models or any other machine learning purposes. Your content is used solely to provide you with the requested sound design services.

3.3 License to Process

By uploading content to Effct, you grant us a limited, non-exclusive license to process your videos for the sole purpose of generating audio enhancements. This license terminates when you delete your content or close your account.

3.4 Data Retention

We retain your uploaded videos and generated audio only as long as necessary to provide the service. You may delete your content at any time from your account dashboard. Upon deletion or account closure, we will permanently remove your content from our systems within 30 days.

3.5 Project Sharing

You may share your projects with other users by providing their email address. When you share a project, the recipient will receive a copy of the project and its associated content. By sharing a project, you acknowledge that your email address may be visible to the recipient, and their email address will be visible to you.

4. Acceptable Use

You agree not to use Effct to:

  • Upload content that violates any laws or infringes on others' rights
  • Upload content containing illegal, harmful, or offensive material
  • Upload content you do not have the right to use or distribute
  • Attempt to reverse engineer, decompile, or hack our service
  • Use the service to spam, phish, or engage in fraudulent activities
  • Overload or interfere with the proper functioning of our systems

5. Generated Audio Content

5.1 License to You

Audio content generated by Effct for your videos is licensed to you for use with your original video content. You may use, modify, and distribute the generated audio as part of your video projects.

5.2 Quality and Accuracy

While we strive to provide high-quality audio generation, the service uses AI technology that may produce varying results. We do not guarantee that generated audio will meet your specific expectations or requirements.

6. Account Responsibilities

You must be at least 18 years of age to create an account and use Effct. By creating an account, you represent that you are at least 18 years old.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete registration information
  • Keep your account information up to date
  • Immediately notify us of any unauthorized access to your account
  • Not share your account with others

7. Subscription and Payment

7.1 Free Trial

We may offer free trial periods for new users. Free trials are subject to limitations and may require payment information.

7.2 Paid Subscriptions

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method for all fees incurred.

7.3 Overage Billing

If your usage exceeds your plan's included minutes, you will be billed for overage at the rates displayed on your billing page. Overage charges are billed at the end of each billing period or when accumulated charges reach a threshold amount.

7.4 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. No refunds are provided for partial billing periods.

7.5 Price Changes

We reserve the right to modify our pricing. We will provide advance notice of any price changes, and changes will apply to subsequent billing periods.

8. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the service at any time, with or without notice. We are not liable for any service interruptions or unavailability.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EFFCT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold Effct harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, your content, or your violation of these terms.

12. Termination

We reserve the right to suspend or terminate your account and access to the service at any time, with or without cause or notice, including for violation of these terms. Upon termination, your right to use the service immediately ceases.

13. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on our website and updating the "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the new terms.

14. Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction in which Effct operates, without regard to conflict of law principles.
